Many parents consider moving back to Poland after a relationship breakdown. The question is whether you can bring your child with you.
Joint parental responsibility requires consent
Where parents share joint parental responsibility, both must as a general rule give their consent before the child can move out of Norway. This applies even if the child lives permanently with you.
If you cannot agree
If you cannot reach an agreement, the matter can be brought before the district court, which will decide what is in the best interests of the child. The child has the right to be heard.
Do not move without resolving the issue first
Taking a child abroad without the necessary consent may be considered unlawful abduction under the Hague Convention, and the child may be required to be returned. Have the matter assessed before you move.
